Weingarten Rights

If an administrator or manager asks to speak with an employee and the employee believes there is a reasonable possibility that discipline or other adverse consequences may result from what they say, the employee has the right to request union representation.

What you can say:

“If this discussion could in any way lead to my being disciplined, terminated, or cause an effect on my personal working conditions, I respectfully request that my Union Representative be present at this time.”

When the employee requests a union representative to be present, management has three options:

  1. They can stop questioning until the representative arrives.

  2. They can call off the interview.

  3. They can tell the employee that they will call off the interview unless the employee voluntarily gives up their right to union representation.

Union Representatives

Members at Large will be your first point of contact should an issue arise at your site. Initial contact can be made via school email by providing your title site issue and giving them your personal contact information. Site issues should only be discussed via personal email or personal text.

Grievence Procedure

  • The Member at Large will then contact the Grievance Chair.

  • The Grievance Chair can contact the TAWC President.

  • The TAWC president can contact CTA support staff.

  • The CTA support staff can contact a lawyer on the member's behalf.

When should I contact my Site Rep?
​

You should ask for union representation any time you feel that a situation or meeting could result in some form of disciplinary action or if you are being accused of a crime.  Your site representative can counsel you on your rights and contact someone to help you.  DO NOT say anything to anyone until your representation has arrived - it is your right.

 

How many sick and personal necessity days can I take each year?
​

You are allowed ten (10) sick days each year. Up to seven (7) of accumulated sick leave may be used in cases of personal necessity.

 

What happens to my unused sick days?
​

Your unused sick days carry over to the next year and will continue to accumulate yearly as long as you do not use them all.  Each year, you are given another 10 days, or 1 day, for every month of your contract, regardless of how many unused days you have on file.
